Terms of Service

These Terms of Service ("Terms") govern your use of the services provided by Coastal Real Estate Photo ("we," "us," or "our"). By booking our services, you agree to these Terms.

1. Services

Coastal Real Estate Photo provides real estate photography, videography, drone aerial services, 3D tours, floor plans, and related media services for property marketing. Services are subject to availability and scheduling.

2. Booking and Scheduling

• Bookings are confirmed upon submission through our website or direct communication with our team.
• A deposit may be required for first-time clients or orders above certain thresholds.
• Preferred dates and times are subject to availability and will be confirmed within 24 hours of booking.
• You are responsible for ensuring the property is accessible and prepared at the scheduled time.

3. Pricing and Payment

• Prices are as listed on our website or as quoted for custom projects.
• Prices may be updated without notice; confirmed bookings honor the price at time of booking.
• Payment is due upon delivery of final media unless other arrangements are made.
• We accept major credit cards, ACH transfers, and checks.

4. Cancellation and Rescheduling

• Cancellations or reschedules made 24+ hours in advance incur no fee.
• Cancellations within 24 hours may be subject to a fee of up to 50% of the booking total.
• Same-day cancellations or no-shows may be charged the full booking amount.
• Weather-related cancellations for drone services will be rescheduled at no additional cost.

5. Delivery

• Standard delivery is 24-48 hours for photography and 48-72 hours for video packages.
• Rush delivery is available for an additional fee.
• Delivery times are estimates and may vary based on workload and project complexity.
• Files are delivered digitally via our secure client portal.

6. Revisions

• One round of minor revisions is included with each order, requested within 5 business days of delivery.
• Minor revisions include color adjustments, item removal, and sky replacement.
• Major changes, reshoots, or additional editing beyond the included revision are quoted separately.

7. Intellectual Property and Licensing

• Coastal Real Estate Photo retains copyright ownership of all media created.
• Upon payment, you receive a non-exclusive license to use the media for marketing the specific property shown.
• This license includes MLS, websites, social media, print materials, and advertising for that property.
• The license does not include resale, sublicensing, or use for properties other than the one photographed.
• Extended licensing for personal branding or other commercial uses is available upon request.

8. Property Access and Preparation

• You warrant that you have authorization to grant us access to the property.
• The property should be prepared for photography per our provided checklist.
• We are not responsible for delays caused by property access issues, incomplete staging, or unprepared conditions.

9. Limitation of Liability

• Our liability is limited to the amount paid for the services in question.
• We are not liable for indirect, consequential, or incidental damages.
• We are not liable for delays or inability to perform due to circumstances beyond our control (weather, equipment failure, access issues).

10. Indemnification

You agree to indemnify and hold Coastal Real Estate Photo harmless from any claims, damages, or expenses arising from your use of our services or media, your breach of these Terms, or your violation of any third-party rights.

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of California.

12. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
